Secure Computing opposes Finjan request for injunction in patent battle

Secure Computing filed a court motion in Delaware on the 26th of March to set aside jury verdict of infringement and to enter judgment that Finjan’s patents are invalid.
Mike Gallagher, Secure Computing’s senior vice president, product development and support, says that there are no patent rights breaches, and have stated the company intends to reject the claims while continuing business as normal.
Mary Budge, senior vice president, secretary and general counsel added, “The District Court Judge in Delaware has not had any opportunity yet to rule on the validity of Finjan’s patents, an opportunity the Court will now have based on the motion we have filed today.”
She says Secure Computing will first seek relief in the trial court and if necessary, appeal. They also intend to proceed with suit against Finjan on the load balancing patent.
Finjan filed several motions last week against Secure Computing after a recent jury ruling found Secure Computing to be wilfully infringing on Finjan’s patent claims.
Finjan is looking for a permanent injunction and damages up to three times the amount the jury awarded, as well as attorney fees and court costs.
